By accessing or using the services provided by evitrack.com (“the Website”), you agree to be bound by these terms and conditions (“Terms”). If you do not agree to these Terms, you may not access or use the Website.
These Terms constitute a legally binding agreement between you and Evitrack Solutions (“we”, “us”, “our”).
Definitions
Hosted Software – means the specific software located in Evitrack Data Center.
Update – means a revision or patch that improves the functionality of Hosted Software, and may contain new features or enhancements.
Documentation License
Subject to the terms and conditions of this agreement, Evitrack grants to Customer a non-assignable, non-transferable license, without the right to sub-license, to use the Documentation in connection with Customer’s authorized use of Hosted Software. Customer may not reproduce or distribute the Documentation in any manner, whether physically or electronically, without the express written permission of Evitrack.
Ownership
Hosted Software and source codes belong to Evitrack. Source code files are not provided.
Guaranteed Uptime
We guarantee an uptime of 99.9% for our Paid Services. Uptime is measured over each calendar month. In the unlikely event that uptime falls below 99.9% in a given calendar month, we will make commercially reasonable efforts to promptly restore service to minimize disruption to your operations.
Our services may be hosted on infrastructure provided by third-party providers such as DigitalOcean, Hetzner and Amazon Web Services (AWS). For information regarding their respective SLAs, check their official websites.

Maintenance Windows
To ensure the continued reliability and performance of our services, we may occasionally need to perform scheduled maintenance. We will endeavor to schedule maintenance during off-peak hours and provide advance notice, whenever possible. However, in emergency situations, we reserve the right to perform maintenance without prior notice to prevent service disruption or security vulnerabilities.
Exclusions
This SLA does not apply to downtime caused by factors beyond our reasonable control, including but not limited to force majeure events, internet outages, or acts of third parties. Additionally, scheduled maintenance windows and downtime related to customer misconfiguration or misuse of the services are excluded from this SLA.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you for the Services during the twelve-month period prior to the claim.
Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website.
Continued use of the Services after any such changes constitutes your acceptance of the revised Terms.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements and understandings, whether oral or written.
